“Drug Minus Two” Amendment 782
In April 2014, the U.S. Sentencing Commission approved Amendment 782, which reduced the sentencing guidelines for all controlled substances by two levels. In July 2014, it was decided that the amendment would be retroactive. The amendment went into effect on November 14, 2014. Inmates who received reduced sentences based on the new guidelines began being released on November 1, 2015.
Sometimes referred to as “drug minus two” or “all drugs minus two,” Amendment 782 was estimated to have impacted the sentences of approximately 46,000 inmates across the United States when it was approved. There are a number of these cases already being reviewed in various state courts.
